Türkiye’den ailesiyle birlikte ABD’ye gelen Kürt kökenli Abdülhalik Yurgun, siyasi görüşleri ve Türkiye’ye dönmesi halinde karşılaşabileceğini belirttiği riskler nedeniyle sığınma başvurusunda bulundu.
Yurgun, Türkiye’de HDP mensubu bazı milletvekilleriyle görüştüğünü, ülkenin yönetim ve hukuk sistemine ilişkin eleştirel görüşlere sahip olduğunu ve Kürtçenin kamusal alandaki konumuna ilişkin mevcut yaklaşımları yeterli bulmadığını ifade ediyor. Bu görüşleri ve siyasi temasları nedeniyle geri dönmesi halinde baskı veya zulümle karşılaşabileceğinden endişe ettiğini belirtiyor.
Başvurusu Hukuki Çerçevede İncelenecek
New Jersey’de yaşayan Yurgun, ABD’de kalması halinde yasalara uygun biçimde çalışmak ve yaşamını burada sürdürmek istediğini söylüyor.
ABD’de sığınma başvuruları, başvurucunun kişisel koşulları ile sunduğu bilgi ve belgeler doğrultusunda yetkili makamlarca değerlendiriliyor. Siyasi görüş veya etnik köken tek başına sığınma hakkı sağlamazken, karar başvurucunun beyanları ve delillerinin yürürlükteki hukuk çerçevesinde incelenmesiyle veriliyor.
Yurgun, başvurusunun özel bir ayrıcalık talebi olarak değil, güvenlik endişelerinin ve sunduğu bilgilerin tarafsız biçimde değerlendirilmesi yönündeki talebi olarak ele alınmasını istiyor.
Başvuruya ilişkin nihai karar yetkili ABD makamları tarafından verilecek.

Abdülhalik Yurgun, a Kurdish man who came to the United States from Turkey with his family, has applied for asylum, citing his political views and concerns about the risks he says he could face if returned to Turkey.
Yurgun says that while living in Turkey, he met with several members of parliament affiliated with the HDP, held critical views regarding the country’s system of government and legal framework, and disagreed with existing approaches concerning the status of the Kurdish language in public life. He says that his political views and contacts have contributed to his fear that he could face pressure or persecution if returned to Turkey.
Application to Be Considered Under U.S. Law
Now living in New Jersey, Yurgun says that if permitted to remain in the United States, he wants to work, obey the law and build his future here.
Asylum applications in the United States are considered individually by the appropriate authorities based on each applicant’s circumstances, statements and supporting evidence. Political opinion or ethnicity alone does not automatically establish eligibility for asylum; each claim must be assessed under applicable U.S. law and the evidence presented.
Yurgun says he is not seeking special treatment. Rather, he is asking that his security concerns and the information supporting his case receive a fair and impartial review.
The final determination on his asylum application will be made by the appropriate U.S. authorities.
